Proposition 1 is an amendment to the New York Constitution aimed at expanding constitutional protections against discrimination based on ethnicity, national origin, age, disability, sex, sexual orientation, gender identity, gender expression, pregnancy, and reproductive healthcare.
• Prop 1 will protect against discrimination in areas such as hiring, pay, and promotions, particularly for older, disabled, pregnant, and LGBTQ+ New Yorkers.
• It will ensure that these groups have equal access to public spaces and facilities.
• The amendment will also protect reproductive healthcare rights, including access to abortion, birth control, and IVF, safeguarding these rights from future legislative changes.
Yes. Prop 1 will prevent future state laws from rolling back current rights to equal treatment for LGBTQ+ individuals. This includes protections against discrimination based on sexual orientation, gender identity, and gender expression.
While Prop 1 does not use the word “abortion,” it unequivocally protects abortion rights and access to reproductive healthcare. This includes preventing any future state laws that would ban or punish pregnancy outcomes like miscarriages or restrict reproductive healthcare access, including birth control and IVF.
• Parental Rights: Prop 1 does not affect parental rights. Parental consent and decision-making regarding healthcare for minor children, including gender-affirming care, are governed by other state and federal laws.
• Sports Participation: Prop 1 does not change existing law regarding participation on sports teams. It aligns with Title IX, which federal courts have interpreted to require that students play on sports teams matching their gender identity and expression.
• Voting Qualifications: Prop 1 does not alter existing state laws regarding voter qualifications. It does not grant voting rights to any new categories of voters.
